To use Cyber Ballet services, you must be of legal age in your jurisdiction. If you are under the required age, you will need your parent or legal guardian's permission to create and use an account. Your parent or legal guardian should review these terms with you and will be responsible for your account activity.

These terms outline your relationship with Cyber Ballet. By using our services, you agree to these terms, which govern how we operate and generate revenue. When we use terms like "Cyber Ballet," "we," "us," or "our," we refer to Cyber Ballet LLC and its affiliated companies.

• Applications and Websites: Search, Maps, and others.
• Platforms: Cyber Ballet Shopping and others.
• Integrated Services: Maps embedded in other apps or websites.
• Devices: Cyber Ballet Nest and others.
• Content: Streamable and interactive content related to our services.

Our services are designed to work seamlessly together, allowing you to effortlessly transition between activities. For instance, clicking on an address in your Calendar event can launch Maps and provide directions.

Continuous Improvement:

Cyber Ballet is constantly innovating and enhancing our services through new technologies and features. We use artificial intelligence (AI) and machine learning (ML) to provide features like real-time translation and improved spam and malware detection. This involves adding or removing functionalities, adjusting service limitations, and introducing or discontinuing services. Downloadable software associated with our services may update automatically on your device with new versions or features. Some services allow you to manage automatic updates.

For significant changes negatively impacting your experience or service discontinuation, we will provide reasonable notice, except in urgent situations related to abuse prevention, legal compliance, or security and operational issues. Additionally, we will offer you a chance to export your content from your account using Cyber Ballet customer services, subject to applicable laws and policies.

• Respect the rights of others: protecting privacy and intellectual property.
• Refrain from harmful or abusive behavior: towards yourself or others, including misleading, defrauding, impersonating, defaming, bullying, harassing, or stalking.
• Avoid harming or disrupting services: refraining from fraudulent or deceptive activities, introducing malware, spamming, hacking, or bypassing our security measures. We respect website owners' restrictions when indexing web content for search results, and the same expectation applies to users interacting with our services.
• Report violations: many of our services offer avenues to report abuse if you encounter users who violate these guidelines. We follow the established procedures outlined in the "Taking Action in Case of Problems" section when addressing reported issues.

Content Ownership:

Certain Cyber Ballet services allow you to upload, submit, store, send, receive, or share content. While providing content is entirely optional, it requires you to possess the necessary rights and ensure the content complies with legal regulations.

Your Content Remains Yours: You retain all intellectual property rights associated with your content, such as reviews, creative works, or shared content with permission. This agreement only covers your intellectual property rights, not your privacy rights.

What's Covered: This license applies solely to your content protected by intellectual property rights. It excludes:

• Publicly Available Information: Common knowledge like business addresses doesn't require a license.
• Feedback: Feedback and suggestions for improving our services fall under the Service-related communications section.

Scope of the License:

• Non-exclusive: You can license your content to others.
• Royalty-free: No monetary fees are associated with this license.
• Worldwide: This license applies globally.

Rights Granted to Cyber Ballet:

• Hosting and Usage: Cyber Ballet can store, reproduce, distribute, and utilize your content for accessibility purposes.
• Publication and Display: We can publish, publicly perform, or display your content if it's publicly visible.
• Modification: Cyber Ballet can modify or create derivative works (e.g., reformatting) from your content.
• Sublicensing: These rights may be sublicensed to:
  • Other users for specific functionalities (e.g., photo sharing with selected users).
  • Our contractors bound by this agreement, solely for the limited purposes outlined below.

Purpose of the License:

• Operating and Improving Services: This license allows us to operate and enhance our services, including creating new features through automated analysis of your content for:
  • Spam, malware, and illegal content detection.
  • Recognizing data patterns for improved functionality (e.g., suggesting related photos in Cyber Ballet Photos).
  • Personalized recommendations, search results, and content (customizable in Ads Settings).
• Promotional Activities: Cyber Ballet may use your publicly shared content for promotional purposes, like showcasing reviews or app screenshots.
• Developing New Technologies and Services: We can leverage this license to develop future Cyber Ballet technologies and services aligned with these terms.

Duration: This license is valid for the entire duration of your content's intellectual property protection.

Content Removal: Upon removal of licensed content from our services, Cyber Ballet will stop making it publicly available within a reasonable timeframe. However, exceptions exist:

• Previously Shared Content: Content already shared with others may still appear in their accounts or search results even after removal from your account.
• Content Accessed Outside Cyber Ballet: Content made available through other platforms might still be discoverable through search engines, including Cyber Ballet Search.

Your Cyber Ballet Account:

An account with Cyber Ballet provides convenient access to many of our services. To create an account, you must meet our age requirements. Certain services, like email through Gmail, require a Cyber Ballet account to function.

Account Security:

You are responsible for maintaining the security of your Cyber Ballet account. This includes taking reasonable steps to keep it secure, like using the Security Checkup tool regularly.

Using Cyber Ballet for Organizations:

Many organizations, such as businesses, non-profits, and schools, utilize Cyber Ballet services. To do so, an authorized representative must agree to our terms. Your organization's administrator may assign you a Cyber Ballet account and set additional rules, including the ability to access or disable your account.

Communication:

To provide our services and keep you informed, Cyber Ballet may send service announcements and other relevant information. For details on how we communicate with you, please refer to our Privacy Policy.

Feedback:

We appreciate your feedback on how to improve our services. While we may act on your suggestions, we are not obligated to do so.

Content you create:

• Sharing your work: Certain Cyber Ballet services allow you to share your creations publicly, such as product reviews, blog posts, and more.
• Understanding your rights: Refer to the "Permission to use your content" section for details on your rights and how your content is used within our services.
• Removing your content: Learn about the reasons and methods for removing your content from our services in the "Removing your content" section.

Cyber Ballet content:

• Our creations: Some of our services feature content belonging to Cyber Ballet, like the visual illustrations in Cyber Ballet Maps.
• Using our content: You may use Cyber Ballet's content as permitted by these terms and any additional service-specific terms. However, we retain all intellectual property rights.
• Respecting our branding: Do not remove, obscure, or alter our branding elements like logos or legal notices. If you wish to use our branding or logos, please visit the Cyber Ballet Brand Permissions page.

Content from others:

• Third-party content: Certain services offer access to content owned by others, such as business descriptions or news articles.
• Permissions and usage: You cannot use this content without the express permission of the owner or as permitted by law.

Some of our services may utilize open-source software under specific license terms, which are provided separately. These open-source licenses may supersede certain terms outlined here. Be sure to carefully review them.

Restrictions:

At Cyber Ballet, we strive to provide you with exceptional services, like Cyber Ballet Search and Maps, that are dependable and meet your evolving needs. However, for legal reasons, our services are offered "as is," without any express or implied guarantees, unless explicitly stated in separate agreements for specific services.

Understanding Our Responsibilities

Both the law and these terms aim to establish a fair balance in terms of what you and Cyber Ballet can expect from each other in case of any issues. While the law allows us to limit certain liabilities, it doesn't apply to everything.

Our responsibility is solely limited to addressing breaches of these terms or specific terms mentioned in separate agreements for certain services, as permitted by applicable law. We are not liable for:

• Loss of potential profits, income, business opportunities, reputation, or savings
• Indirect or consequential losses
• Penalties

Our total liability for any situation arising from or related to these terms is capped at the greater of $200 or the fees you paid for the relevant services in the past year.

Additional Terms for Businesses and Organizations

If you're a business user or organization, you agree to shield Cyber Ballet, its directors, officers, employees, and contractors from any legal actions initiated by third parties (including government authorities) that stem from your unlawful use of the services or violation of these terms or separate agreements for specific services. This protection covers any liabilities or expenses arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.

It's important to note that if you are legally exempt from specific responsibilities, such as indemnification, then those exemptions apply to you under these terms.

Taking Action When Necessary

Before taking any action as outlined below, we will, whenever reasonably possible, provide you with advance notice, explain the reason for our action, and offer you a chance to rectify the situation, unless doing so would:

• Cause harm or legal repercussions to a user, third party, or Cyber Ballet
• Violate the law or a legal order
• Jeopardize an investigation
• Compromise the operation, integrity, or security of our services

Removing Your Content

We reserve the right to take down some or all of your content if it:

• Breaches these terms, separate terms for specific services, or our policies
• Violates applicable law
• Poses a potential threat to our users, third parties, or Cyber Ballet

Examples of such content include child pornography, content that facilitates human trafficking or harassment, content that promotes terrorism, and content that infringes on someone else's intellectual property rights.

Suspending or Terminating Your Access to Cyber Ballet Services

• Your actions cause harm or legal repercussions to a user, third party, or Cyber Ballet, such as hacking, phishing, harassing, spamming, misleading others, or scraping content that doesn't belong to you

Dispute Resolution, Governing Law, and Jurisdiction

These terms, any separate terms for specific services, and any related services will be governed by Delaware law, irrespective of any conflict of laws principles. Any disputes arising from these terms will be resolved exclusively in the federal or state courts of New Castle County, Delaware, USA. You and Cyber Ballet hereby agree to the personal jurisdiction of these courts.

Your Rights:

• This agreement respects your legal rights, which cannot be restricted by these terms.
